5. Penalties
As per Section 10 of the Act, if any employer (a) makes any recruitment in contravention of the provisions of the Act, or (b) makes any payment of remuneration at unequal rates to men and women workers, for the same work or work of similar nature, or (c) makes any discrimination between men and women workers in contravention of the provisions of the Act, he would be punished with fine not less than

10,000/- but which may extend to

20,000/- or with imprisonment for a term not less than 3 months but which may extend upto one year or both for the first offence and which may extend upto 2 years for the second and subsequent offences.
